Terms & Conditions
Last updated: 1 October 2026
These Terms apply to purchases made by consumers from Hunters (Derby) Limited trading as Hunters of Derby ("Hunters", "we", "us" or "our"). Please read them before placing an order. Nothing in these Terms affects your statutory consumer rights.
1. About Hunters
Hunters (Derby) Limited t/a Hunters of Derby
34 Babington Lane, Derby DE1 1SY
Company number: 02298127 | VAT number: 507865425
Telephone: 01332 349285 | Email: info@huntersfurniture.co.uk
These Terms apply where you are buying wholly or mainly for personal use. Different terms may apply to business purchases.
2. Orders, prices and payment
Product displays, website listings and quotations are invitations to place an order.
A contract is formed when we accept your order and confirm it, usually by accepting the agreed payment or deposit and providing an order confirmation.
Please check your order confirmation, specification and any drawings carefully and tell us promptly if anything is incorrect.
Prices are in pounds sterling and include VAT unless stated otherwise. Any delivery or other charges will be made clear before your order is accepted.
For showroom, kitchen and special-order purchases, we may require a deposit followed by a balance payment. Unless otherwise stated on your quotation or order confirmation, the balance must be received in cleared funds at least 24 hours before delivery or collection.
Kitchen and other substantial projects may have individual payment arrangements shown on the quotation. Those arrangements form part of your contract.
If an obvious pricing or description error is identified before we accept an order, we may correct it before accepting the order.
We will not increase an agreed price after acceptance without your agreement except where the contract expressly permits an adjustment required by law, such as a change in the applicable rate of VAT.
3. Products, materials and finishes
We take reasonable care to ensure that descriptions, photographs, samples and measurements are accurate.
Images are illustrative and colours may appear differently depending on lighting, photography and screen settings.
Natural materials including wood, leather, stone and marble naturally vary in grain, colour, texture and markings. Painted, handmade and hand-finished products may also show reasonable variation. These characteristics are not normally defects.
Where you choose a product from a sample, there may be reasonable differences between the sample and the finished item arising from the nature of the material or manufacturing process.
Goods must nevertheless correspond with their description and meet the standards required by law.
4. Cancelling an order and deposits
Orders made in our showroom
There is normally no statutory cooling-off period where a contract is concluded in our showroom simply because you later change your mind.
If you ask us to cancel an accepted order and you do not have a statutory or contractual right to cancel it, we will try to minimise the financial loss resulting from your cancellation.
We may use money you have already paid towards the reasonable net losses directly caused by the cancellation. These may include supplier charges and non-refundable commitments already made for your order, loss in value of specially ordered goods, reasonable costs already incurred and, where legally recoverable, loss of profit.
We will take reasonable steps to reduce those losses, including cancelling supplier orders where possible and taking account of goods which can reasonably be returned, reused or resold.
If our reasonable net loss is less than the amount you have paid, we will refund the balance. If our reasonable net loss exceeds the amount already paid, we may seek payment of the difference.
We will not recover the same loss twice or charge more than our reasonable net loss.
Online, telephone and other distance orders
Where the Consumer Contracts Regulations give you a statutory right to cancel, you may normally cancel from the date the contract is made until 14 days after you receive the goods without giving a reason.
After notifying us that you wish to cancel, you must normally return the goods within a further 14 days.
You will normally be responsible for the direct cost of returning the goods unless they are faulty or we have agreed otherwise.
We will refund the amount required by law, including the cost of our standard delivery service where applicable. We may make a deduction if the value of the goods has been reduced because they have been handled beyond what would reasonably be permitted in a shop.
You can notify us of cancellation by email, post or another clear statement. Where applicable, information about the statutory cancellation form will be provided separately.
5. Made-to-order, personalised and special-order goods
Much of the furniture and many of the kitchen products we sell are ordered specifically for an individual customer.
For distance or off-premises contracts, the statutory 14-day change-of-mind cancellation right does not apply to goods which are genuinely made to your specifications or clearly personalised.
Examples may include individually altered dimensions, specially manufactured components, certain bespoke worktops, made-to-measure products and other goods created or altered to an individual specification.
The fact that an item has been specially ordered from a supplier or is not normally held in stock does not, by itself, necessarily make it legally personalised.
For contracts concluded in our showroom there is normally no statutory change-of-mind cancellation right in any event.
Once we have committed to supplier orders, manufacture or customer-specific work, cancelling a special order may result in significant costs. Any amount retained or claimed following cancellation will be dealt with in accordance with section 4 and will reflect our reasonable net loss rather than an automatic penalty.
This does not affect your rights where goods are faulty, misdescribed or otherwise fail to comply with the contract.
6. Kitchens and design projects
Kitchen projects can involve goods being sourced from several suppliers, including cabinetry, appliances, worktops, sinks, taps, tiles, lighting and other products.
Once you approve the quotation, specification and relevant drawings, we may place supplier orders and incur commitments specifically for your project.
Please check layouts, appliances, finishes, colours, quantities and specifications carefully before giving approval.
If we carry out measurements or a survey, we will do so with reasonable care and skill. Where measurements, drawings or other information are supplied by you or by your architect, builder, installer or another third party, we are entitled to rely reasonably upon that information unless we have agreed to verify it ourselves.
Changes requested after an order has been approved are subject to our agreement and may result in additional costs, supplier charges or changes to delivery dates. We will explain material additional charges before proceeding where reasonably practicable.
Kitchen installation
Hunters does not itself provide or contract to provide kitchen installation services.
For convenience, we may introduce you to an experienced independent kitchen installer and may show an installation price on our kitchen quotation so that you can understand the anticipated overall project cost.
Unless we expressly state otherwise in writing, any installation amount shown on our quotation is payable directly to the independent installer and does not form part of the amount payable to Hunters.
The installation service is a separate contract between you and the installer. The installer is responsible for agreeing the scope of their services with you, for their own work and for invoicing and receiving payment from you directly.
A dispute with, or decision to stop using, an independent installer does not by itself cancel or give you a right to cancel your separate contract with Hunters for the supply of your kitchen and other goods.
Builders and other trades
Hunters does not contract to provide building work.
We may recommend builders, electricians, plumbers, decorators or other tradespeople based on our previous experience of their work.
Where a tradesperson quotes you directly, contracts with you directly and is paid by you directly, their work is entirely separate from your contract with Hunters.
The independent tradesperson is responsible for their own work and for complying with the terms of their contract with you.
A recommendation by Hunters reflects our experience at the time it is made but is not a guarantee of a tradesperson's future performance. Nothing in this section excludes responsibility which the law places on Hunters for our own statements or conduct.
A dispute with an independent builder or other tradesperson does not by itself give you a right to cancel goods ordered from Hunters.
7. Delivery, access and storage
Any delivery date or lead time we give is an estimate unless we expressly agree that a particular date is guaranteed or essential.
Made-to-order furniture and kitchen products can have lengthy manufacturer lead times. Where we agree a lead time with you, this will form part of the order.
We will tell you if we become aware of a significant delay.
You are responsible for making sure that goods can reasonably be delivered into your property and into their intended position. Please check doors, hallways, staircases, lifts and other access restrictions before ordering and tell us about unusual or difficult access in advance.
Our delivery team is not required to attempt anything it reasonably considers unsafe or likely to cause significant damage.
If delivery cannot take place because nobody is available, the property is not ready or suitable access has not been provided, we may charge reasonable additional costs actually incurred for storage or redelivery.
If goods are ready but you ask us to postpone delivery for a substantial period, reasonable storage charges may apply. We will tell you about these before they are incurred where reasonably practicable.
Risk in the goods passes to you when you or a person nominated by you takes physical possession of them, subject to applicable law.
Ownership of goods remains with Hunters until they have been paid for in full, so far as permitted by law.
8. Damage, faults and your statutory rights
Please inspect goods as soon as reasonably practicable after delivery.
If you notice visible damage, please tell our delivery team where possible and contact us promptly. We ask customers to report visible delivery damage ideally within 48 hours and provide photographs where reasonably possible because this helps us investigate quickly.
The 48-hour request does not limit your statutory rights.
Goods supplied by Hunters must be of satisfactory quality, fit for any particular purpose made known to us where the law requires this, and as described.
If goods are faulty or do not conform to the contract, you have rights under the Consumer Rights Act 2015. Depending on the circumstances, these may include rejection, repair, replacement, a price reduction or refund.
Normal wear and tear, accidental damage, misuse, neglect or damage caused by failure to follow reasonable care or operating instructions is not a product fault.
Please contact us if you believe there is a problem and we will investigate it fairly.
9. Guarantees and warranties
All products supplied by Hunters are covered by a minimum 12-month warranty.
Some products supplied by Hunters are covered by a manufacturer's or supplier's guarantee. The length and terms of these guarantees vary by product and manufacturer, and details are available from us on request.
Where a manufacturer's or supplier's guarantee applies, we will assist you with the relevant information and claims process where appropriate.
Any manufacturer's, supplier's or other commercial guarantee is provided in addition to your statutory rights and does not replace or restrict those rights.
Your statutory rights against Hunters as the retailer are not limited to the duration of any manufacturer's or commercial guarantee.
10. If we cannot supply your order
Occasionally a manufacturer may discontinue a product or circumstances outside our reasonable control may prevent us supplying something you have ordered.
If this happens, we will contact you and discuss any reasonable alternative where appropriate.
We will not substitute a materially different product without your agreement.
If we have to cancel goods because we cannot supply them and you are not responsible for the cancellation, we will refund the amount you have paid for those goods.
11. Our responsibility to you
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing limits your statutory rights or our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
We are responsible for loss or damage which is a foreseeable result of our breach of contract or failure to use reasonable care and skill.
We are not responsible for loss caused by matters for which you or an independent third party are responsible, except where the law provides otherwise.
Where goods are purchased as a consumer for domestic use, we are not responsible for losses arising solely from use of those goods for business purposes, such as loss of profits, revenue or business opportunity.
12. Care of your products
Please follow the manufacturer's and Hunters' reasonable care, maintenance and operating instructions.
Certain natural materials and painted finishes may be affected by moisture, heat, sunlight, humidity and normal use.
We are not responsible for damage caused by misuse, neglect, accidental damage or failure to follow reasonable care instructions.
This does not affect your rights where goods are themselves defective.
13. Complaints
We want to resolve problems fairly and promptly.
Please contact Hunters of Derby, 34 Babington Lane, Derby DE1 1SY, telephone 01332 349285 or email info@huntersfurniture.co.uk. Please provide your name, order number and details of the issue.
We will investigate your complaint and respond as soon as reasonably practicable.
Making a complaint to us does not affect your statutory rights.
If you are dissatisfied with our response and your agreement is regulated by the Financial Conduct Authority, you have the right to refer your complaint to the Financial Ombudsman Service, free of charge, but you must do so within six months of the date of the final response or 8 week holding letter. Further information and contact details can be found on www.financial-ombudsman.org.uk.
14. General
The Terms which apply to your order are those provided or made available to you before your contract is formed.
We may update these website Terms from time to time, but a later change will not retrospectively alter an existing contract unless you agree to the change.
If any part of these Terms is found to be unlawful or unenforceable, the remainder will continue to apply.
These Terms and contracts made under them are governed by English law.
If you are a consumer, nothing in this section removes any right you have under applicable law to bring proceedings in another court with jurisdiction.
